Number of convictions

The number of judicial convictions in 2010 (38 394) raised by 1.4% (+526 cases) in comparison with reporting year 2009. This meant that the number of convictions raised again after it had fallen to a historical all-time low last year. Overall, the number of convictions (based on 1 000 persons legally considered as of the age of criminal responsibility) for 2010 was 5.30, the second lowest figures since these statistics were first compiled in 1947.

The number of convicted adults (35 331) raised by 1.8% (+618 cases) compared to 2009. However, the number of convicted young persons (3 063 cases) decreased by 92 cases (-2.9%) in comparison to the previous year.

In 2010, the number of criminal convictions for crimes in contravention of the Austrian Criminal Code (33 033) increased by 0.1% (+34 cases) compared to 2009. Broken down by type of offence, there was an increase of convictions in most subgroups. Convictions for offences against the administration of justice increased by 17.1% (+182 cases), those against the reliability of documents (e.g. forgery) by 9.6% (+100 cases) and those against state authority by 8.5% (+71 cases). However, there was a relatively strong decline in some subgroups. Convictions for offences against life and limb dropped by 2.8% (-269 cases), those against property by 0.9% (-133 cases) and those against marriage and family by 2.8% (-46 cases).

The number of convictions in contravention of supplementary penal provisions outside the Austrian Criminal Code (5 361 cases in total) increased in comparison to the previous year by 10.1% (+492 cases); convictions for offences in contravention of the Narcotic Substances Act raised by 11.1% (+435 cases) to 4 363.

Statistics on recidivism

In 2006, 38 566 persons were legally convicted (expect for unconditional prison sentence) or released from prison. About one-third (14 673 persons) was convicted again in the years 2006 to 2010. The other two-thirds (23 893 persons) didn’t come into conflict with the law by 2010. 53.7% of the recidivists had one conviction in the observation period from 2006 to 2010, about one-fourth (24.5%) had two or three convictions and about one-fifth (21.7%) was convicted again 4 times or more.
